Trading Assistant Contract

Olen Batchelor, Auction Einstein (Trading Assistant) accepts as listing agent for eBay sale from _________(Seller), the items listed on the attached inventory form. Seller warrants to Assistant and any subsequent purchaser that Seller has full title to all the items to be sold. Seller also warrants that all information regarding the items is true and correct and will pay a fee of $100 for negative eBay feedback resulting from misrepresentation of item(s).

Seller will pay $150 as non-refundable research and listing fees for profession quality eBay listings and photographs. In addition, Seller will pay $150 successful auction fee upon the sale of the item. Any sale resulting in any way from the eBay listings will be subject to this fee and Seller warrants that information regarding the sales of items and their sale prices shall be true and correct. Payment of successful auction fees will be made by Seller within 5 days after receipt of payment from the buyer.

Seller remains as owner of the item until buyer has received and accepted same. Seller agrees that Assistant is hereby appointed and is acting solely as listing agent for the Seller in selling the items.

If Seller decides to withdraw the items for sale from the auction before the item is sold, Seller must notify the Assistant by email or phone. Seller will be responsible for an additional $100 fee plus any additional fees incurred if the item is withdrawn from sale after the successful completion of an auction, or if Seller fails to follow through on the sale. Seller acknowledges that the amount of the listing and research fee originally paid was based on the Assistant's anticipation of receiving a final fee upon the sale of the item(s).

Seller is responsible for eBay relisting (maximum $55.00) fees to be added, to successful Auction Fee. Seller may relist one time at no extra cost in service fees. Seller pays only additional eBay listing fees which are only $25 if the item sells.

Prior to listing any of the items for sale, Assistant and Seller shall establish a reserve price for each item. If the reserve is not met, Assistant may agree to relist item(s) one time with no additional charges beyond the eBay relisting fees. Or he may agree to sell the item for less than the agreed upon reserve amount. In such an instance, the fees remain the same.

This contract shall be for a term of 2 months beginning on the date below.
This agreement constitutes the entire understanding of the parties signing it. It cannot be changed without written permission of both parties.

Should any disputes arise concerning any matter referred to in this contract, both parties will refer the dispute to arbitration.
This contract is governed and shall be interpreted under the laws of the State of Tennessee. I have read the terms above and agree to them this __th day of _______, 2005
